Determining if employment relationship really existed


Employment relationship is a contractual relationship, where one party undertakes to perform specific labour, personally, on behalf and risk and under the management of the other party, referred to as the employer. The employer, in turn, is obliged to provide employment against payment. The employment relationship is formed following unanimous declaration of will by both parties or other events regulated in the Labour Code.
